Terms of Service

1. Service Definition

SetupCross is a SaaS platform operated by Fansister Technology Limited (Hong Kong) (hereinafter “the Company”) providing Hong Kong and Singapore company incorporation, fintech account matching, AI bookkeeping and tax filing assistance, and trademark registration services. The Company is not a law firm, and the services do not constitute legal advice.

2. Eligibility

Natural persons or legal entities aged 19 or older who are not subject to OFAC or UN sanctions. Accurate information must be provided for KYC at the time of registration. If false or missing information is discovered, the contract may be terminated immediately with no obligation to refund.

3. Pricing & Payment

We operate on fixed pricing with all costs, including government fees, disclosed upfront. Amounts displayed in local currencies (KRW, JPY) may vary due to exchange rate fluctuations at the time of payment.

4. Bank Account Opening Guarantee

"Bank account opening guarantee" applies only to fintech partners pre-matched by SetupCross and is offered to clients meeting all of the following: (1) resident of Korea or Japan at time of application, (2) not subject to OFAC or UN sanctions, (3) lawful business purpose declared, (4) application and KYC documents submitted accurately per SetupCross guidance. If all four partners decline, 100% of service fees (excluding government fees) will be refunded. See Refund Policy for full terms.

5. Refund Policy

Refunds are available within 30 days of application and only before government registration is complete. After registration, partial refunds apply to unused services, excluding government fees.

6. Limitation of Liability

The Company’s total liability shall not exceed the aggregate service fees paid by the customer in the preceding 12 months. The Company shall not be liable for indirect damages, lost profits, data loss, or reputational harm, to the maximum extent permitted by applicable law.

7. Service Changes & Suspension

The Company may modify or suspend services with 30 days’ prior notice. Immediate changes necessitated by government policy changes, fintech partner policy changes, or other circumstances beyond the Company’s control may be followed by post-hoc notice.

8. Dispute Resolution

These terms shall be governed by the laws of Hong Kong. Disputes shall be resolved through arbitration at the Hong Kong International Arbitration Centre (HKIAC).
